By accessing our Site or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access our Site or use our Services.

2. Description of Services

Student Debt Shield is a document preparation service that assists clients in completing and submitting federal student loan forms and applications. Our Services include, but are not limited to:

  • Preparation of Income-Driven Repayment (IDR) applications
  • Completion of loan consolidation forms
  • Preparation of Public Service Loan Forgiveness (PSLF) applications
  • Completion of deferment and forbearance requests
  • Preparation of rehabilitation and recertification documents
  • Submission of completed forms to loan servicers on your behalf
  • Ongoing support and document monitoring services

3. Important Disclaimers

  • Not a Law Firm: We are not attorneys, a law firm, or a legal service provider. We do not provide legal advice.
  • Not Government Affiliated: We are not affiliated with, endorsed by, or connected to the U.S. Department of Education, any loan servicer, or any government agency.
  • Document Preparation Only: Our services are limited to document preparation. We do not negotiate with creditors, settle debts, or provide credit repair services.
  • No Guarantee of Results: We cannot guarantee approval of any application, specific payment amounts, loan forgiveness, or any particular outcome.
  • Free Government Services: You can complete and submit all federal student loan forms yourself at no cost through StudentAid.gov and your loan servicer.

4. Eligibility and Account Registration

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Provide accurate, complete, and current information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.

5. Fees and Payment

Our Services are provided for a fee, which will be clearly disclosed to you before you engage our Services. Payment terms include:

  • All fees are quoted in U.S. dollars
  • Payment is required before document preparation begins (unless otherwise agreed)
  • We accept payment via credit card, debit card, or other approved methods
  • All fees are non-refundable once work has begun, except as required by law
  • Fees do not include any government filing fees or loan servicer charges
  • We reserve the right to change our fees with 30 days' notice

Failed payments may result in suspension or termination of Services. You are responsible for any collection costs, legal fees, or other expenses incurred in collecting overdue payments.

6. Client Responsibilities

As a client, you agree to:

  • Provide accurate, complete, and truthful information
  • Respond promptly to our requests for information or documentation
  • Review all documents before submission and notify us of any errors
  • Understand that you are ultimately responsible for the accuracy of information provided
  • Continue making student loan payments until notified by your loan servicer of any changes
  • Monitor your loan servicer communications and notify us of any issues
  • Comply with all federal student loan program requirements

Failure to provide accurate information or fulfill your responsibilities may result in delays, application denials, or termination of Services.

7. Intellectual Property Rights

All content on our Site, including text, graphics, logos, images, software, and trademarks, is the property of Student Debt Shield or its licensors and is protected by U.S. and international copyright and trademark laws.

You may not copy, reproduce, distribute, modify, or create derivative works from our content without our express written permission. Limited use is permitted for personal, non-commercial purposes only.

8. Prohibited Uses

You agree not to:

  • Use our Services for any illegal or unauthorized purpose
  • Provide false, misleading, or fraudulent information
  • Violate any laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the operation of our Site or Services
  • Use automated systems (bots, scrapers) to access our Site

9. Limitation of Liability

IMPORTANT LIABILITY LIMITATION:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDENT DEBT SHIELD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

We are not liable for application denials, payment outcomes, delays by loan servicers, changes in federal programs, or any decisions made by the U.S. Department of Education or loan servicers.

10. Warranties and Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • Our Services will meet your specific requirements or expectations
  • Our Services will be uninterrupted, timely, secure, or error-free
  • Any applications prepared will be approved
  • You will achieve specific financial outcomes
  • Information on our Site is complete, accurate, or up-to-date

11. Indemnification

You agree to indemnify, defend, and hold harmless Student Debt Shield and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any law or third-party rights; or (d) any information you provide to us.

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Providing false or misleading information
  • Non-payment of fees
  • Engaging in prohibited conduct
  • At our sole discretion for any reason

Upon termination, your right to use our Services will immediately cease. Termination does not relieve you of your payment obligations for services already rendered.

13. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or unauthorized use of our Services.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which our principal office is located, without regard to conflict of law provisions.

To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the state and federal courts located in our jurisdiction for resolution of any disputes.

15. Cancellation and Refund Policy

Right to Cancel: You have the right to cancel our Services within three (3) business days of signing the service agreement for a full refund, provided no work has been performed.

After Work Begins: Once we have begun work on your documents, fees are non-refundable. However, we will work with you to address any concerns about the quality of our Services.

State-Specific Rights: Some states provide additional cancellation rights. Please contact us if you believe you have state-specific cancellation rights.

16. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to our Privacy Policy and agree that we may collect, use, and share your information as described therein.

17. Electronic Communications and Signatures

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Sending email notification to registered users
  • Displaying a prominent notice on our homepage

Your continued use of our Services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using our Services.

20. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
